General terms and conditions
These General Terms and Conditions apply to customers outside Finland.
1. Registration and Use of Web shop
1.1. Placing an order at the web shop of AVA Room Oy (”AVA ROOM”) does not require registration with the Customer Register. AVA ROOM collects only the required data to implement your order.
1.2. In connection with an order or otherwise, a customer can register with AVA ROOM Customer Register, in connection with which the customer agrees to include his/her personal data in AVA ROOM Customer Register. This simplifies processing customer’s further orders and allows customer to follow his/her orders made after such registration.
1.3. The customer can also register with AVA ROOM VIP Customer Register by expressly providing his/her consent to receive newsletters and information on offers to his/her email. The customer thereby agrees that AVA ROOM collects the necessary contact information to its VIP Customer Register.
1.4. When using the web service or web shop as well as when registering with AVA ROOM Customer Registers you agree to
1.4.1. Use the web service and web shop in accordance with these General Terms & Conditions;
1.4.3. Observe express diligence and caution when using the web shop;
1.4.4. Provide truthful information about you as well to change this information when necessary;
1.4.5. Obtain the consent of your guardian for your purchase in the event you are under 18 year’s old;
1.4.6. Keep your username and password secret, not to give them to third parties as well as to be responsible in the event someone else uses your username and/or password in our web shop; and
1.4.7. Immediately AVA ROOM in the event your username and/or password have come into the knowledge of a third party, in which case AVA ROOM reserves the right to immediately remove your username and password from use.
2. Validity of Order
2.1. You can easily place orders to our web shop 24 hours per day. Products are ordered by placing them in the shopping cart. Follow the instructions provided by the web shop in order to complete your order. The order confirmation page shows the aggregate payable amount inclusive all taxes and delivery costs.
2.2. A binding Contract of Sales becomes valid when AVA ROOM has sent you an order confirmation by email. Thereafter AVA ROOM does not have the right to change the terms applicable to your order.
2.3. A consumer has the right to, partly or fully, cancel the order prior to its delivery by email, letter or telephone. Delivery has taken place when the consumer has received the ordered products or a notification confirming that the ordered products can be collected from the post office.
2.4. AVA ROOM and the customer keep contact either by using email, letter or telephone. Our professional personnel is happy to help our customers on weekdays between 10 a.m. and 4 p.m. (GMT +2) and Saturdays from 10 a.m to2 p.m. in all inquiries as well as in all matters relating to orders. 3.1. All prices in our web shop are inclusive value added tax (VAT 24%). The prices in our web shop are shown in euros (EUR). Offer prices have been marked clearly and separately per product.
3.2. The cost of delivery of furniture per order to Finland is 69 euros without the floor carrier and 99 euros with the floor carrier. Delivery and installation service per order in the Uusimaa region is 200 euros. The cost of shipping textiles and foam mattresses to Finland is EUR 9.75.
3.3. When ordering products outside Finland, we kindly ask you contact our customer service by email at email@example.com or by telephone on weekdays between 10 a.m. and 4 p.m. (GMT +2) and on Saturdays from 10 a.m. to 2 p.m. at our Customer Service number +358 45 165 50 51.
3.4. Customers ordering products to be delivered outside the EU are, in addition to the postage fees provided in Section 3.2 above, responsible for any customs or other government fees applicable to their order.
3.5. We reserve the right to cancel an order on the basis of clear errors in pricing. In the event that a product does not have pricing information, the price has been set to EUR 0.00 or the price clearly deviates from its correct price (e.g. EUR 150.00 price has been set to EUR 15.00), the customer should have understood that the pricing information contains an error.
4. Terms of Delivery
4.1. If the product you are ordering is in stock, our estimated delivery time will be approximately 1-2 weeks. We have a number of custom products in our product range, which are manufactured every time an order is placed. Estimated delivery time on order products is 1 - 12 weeks. We will inform you if the delivery time differs significantly from the above.
4.2. In the event a product delivery is required per a certain date, such request must be informed in connection with the order. We will use our best endeavours to fulfil such request, if possible.
4.3. Upon receipt of the order, we will notify you whether it is a stock item or an order item. We will advise you on the product page if the delivery time for the product is significantly longer than stated in section 4.1. We will also inform on the product page, if the product is sold out, there only is a limited lot of the product available, or if for reasons beyond our control, the delivery will be prolonged. We are not able to respond to continuous interim inquiries on the delivery time or completion of the products.
4.4. In the event a consumer orders several products with different delivery times, the products will be delivered together in accordance with the longest delivery time, unless otherwise has been specifically agreed.
4.5. AVA Room Oy delivers products to Finland and parts of Europe. All AVA Room Oy deliveries are made via DB Schenker or Itella Logistics. If the consumer wishes to use different transportation services, they represent and propose to be separately agreed with AVA Room Oy.
4.6. AVA ROOM also delivers products to the Åland Islands, in which case we deduct the VAT on the order in advance.
4.7. AVA ROOM is not responsible for any damages or delays which are due to force majeure or similar reasons beyond its control which it could not have reasonably predicted or the consequences of which could not be avoided. Force majeure and similar reasons consists of, but is not limited to the following: import and exports bans, industrial actions, sick leave of personnel, authority decisions, equipment or personnel related problems of cooperation ateliers, delays in fabric deliveries, disruptions in transportation, war, natural disasters, or any other similar reason. In the event the force majeure or similar reason continues for more than three months, both the consumer and BYPIAS have the right to cancel the order/agreement without any damage or other consequences.
5. Terms of Payment
5.1. You have access to payment buttons at all Finnish banks. You can pay with the payment buttons of Aktia, Danske Bank, Handelsbanken, Nordea, My Savings Bank, Cooperative Bank, POP Bank, Savings Bank, S Bank and Ålandsbanken. By using Checkout Finland, you agree to the terms of Checkout Finland Oy (2196606-6), available at www.checkout.com/consumers. Your bank statement shows Payout Finland as a payee, which forwards your payment to AVA ROOM. The online shop will direct you directly to your bank to make a secure payment.
a) Prepay by bank transfer using the bank payment buttons: We will ship your order after the payment has been made, within the timeframe indicated above (in the shipping).
b) Prepay by bank transfer: We will ship your order within the timeframe mentioned above (in the "Delivery" section) after the payment is logged in to our account. The size of the payment order and the payment details can be found in the order confirmation sent by the online store. When ordering with prepayment, the order is valid for two weeks (14 days), unless the payment is logged in to our account within that time, we will consider your order canceled.
c) Invoicing: We can charge the city / municipality and business customers. Invoicing should be agreed separately with AVA ROOM by contacting our customer service.
Invoice and installment services through Checkout are provided by OP, Collector and Jousto. Collector also offers invoice and installment options to corporate customers. Please read the specific terms and conditions of the finance company that you will see when you accept the payment. By accepting the payment, you agree to the terms and conditions of the finance company.
6.1. It is important to us that you are satisfied with your order. The customer is allowed to return unused goods within 14 days from receiving them, excluding the receiving day. The product and its package have to be in the same condition than it was when the customer received.
6.2. Custom made and outlet products are non-returnable. Custom made products include e.g. all non-standard products. Custom made products also include AVA Bed covers, Pillow Bags and Upholstery.
6.3. Before returning the product, please send an email notification to firstname.lastname@example.org or call 045 165 5051. Please contact AVA ROOM Oy for detailed return instructions.
6.4. Within 14 days AVA Room Oy will refund the purchase price of the product (s) minus the return freight (EUR 9.75-99.00). Shipping costs are not included in the purchase price of the product (s). We do not refund shipping costs. Not picking up an order is not the same as returning a customer.
6.5. If you would like to cancel your order after it has been shipped to you, please pick up the post and return it to us following these instructions. We will subsequently charge the customer for any additional packing, shipping and return costs (EUR 9.75) incurred due to the customer's failure to collect the item and return it to AVA ROOM.
7. Transport damages
7.1. Sometimes the cases might damage during the transport despite the careful packaging. Therefore, it is a good idea to check the condition of the package and its contents in the presence of the driver when receiving the package. If the package is damaged during transport and if the ordered product (s) is damaged, make an immediate note with the driver (DB Schenker, Itella Logistics or AVA Room Oy are not obliged to deliver the new product free of charge if the note is missing). Then contact our customer service to arrange a new product delivery.
8.1. If the wrong product, etc., has been delivered to the consumer, the consumer must inform AVA Room Oy within a reasonable time, either by e-mail to email@example.com, or by post or by telephone on 045 165 50 51. Returns are made in accordance with AVA Room Oy's instructions only after the complaint has been made. Upon receipt of the returned item, AVA Room Oy will refund any purchase price already paid within 14 days.
9.1. AVA Room Oy provides all products for at least half according to the Consumer Protection Act-year warranty. The warranty does not cover normal wear and tear caused by use.
10. Changes in Terms and Conditions
10.1. AVA ROOM reserves the right to change its general terms and conditions and other terms and conditions applicable to the online store, such as customer return and privacy terms and prices. It is the customer's responsibility to read the applicable terms and conditions before placing an order.
11. Governing Law and Jurisdiction
11.1. The web shop of AVA ROOM as well as all related transactions and agreements are governed by the laws of Finland, unless mandatory consumer protection laws of some other country must be applied. All disputes will be resolved at the District Court of Helsinki.
